Questions people ask

What happens to a safe deposit box if the rent is not paid?

The short answer

In Florida, property in a bank safe deposit box is presumed unclaimed if the owner has not claimed it within 3 years after the rental period expires, and passes to the Department of Financial Services. A private vault’s rental agreement sets what happens when rent lapses there.

The longer answer

For bank boxes, Florida law sets the outcome. Under § 717.116, property held by a banking or financial organization in a safe deposit box is presumed unclaimed if the owner has not claimed it within 3 years after the rental period expires. Unclaimed property goes to the Florida Department of Financial Services.

The department commonly sells tangible property and holds the proceeds for whoever later proves a claim. So a ring, a watch or a coin collection can come back as a check. The check reflects a sale price, and it says nothing about what the ring meant to the family.

For someone serving a long sentence, the problem is timing. A box rented one year at a time, with the bill going to an address nobody checks, can lapse early in the sentence. Three years after that, a bank box is presumed unclaimed. The person inside may not hear of it until release.

Whether § 717.116 applies to a private, non-bank vault is not settled here. How a private vault handles lapsed rent is set by its rental agreement. Ours is TODO_FACT: what Florida Intervault does when rent lapses: notices, grace period, when a box is drilled, what is done with contents, and the answer will sit on if rent lapses.

Matching the term to the length of the absence

The plainest fix is a rental term as long as the absence. We offer multi-year terms: 20% off each year’s rent on a 3 to 5 year rental, and 25% off each year’s rent on 5 years or more. On the smallest box, 3 years comes to $636 a year, or $1,908 for the term.

Whether the full term is paid at signing, and what happens to prepaid rent if the box is closed early, is TODO_FACT: prepaid terms: paid in full up front? refund if closed early?. Both answers belong on prepaid multi-year terms. For how a vault compares with a relative’s home or a storage unit over the same years, see where to store valuables during a sentence.

Whatever the term, give the vault an address someone reads, and name the agent who will deal with it. A notice sent to an empty apartment reaches nobody. When the agent moves, the address on file should move with them. And if the box may hold anything that is part of the case, ask the attorney before it goes in. Rent paid or unpaid, we honor valid warrants, subpoenas and court orders.
